Facts
On Sept. 29, 1992, the plaintiff, a 68-year-old woman, presented to the Breast Diagnostic Center for pre-operative needle localization under mammographic guidance. The procedure was performed by defendant Bienvenida Serrano-Cruz, M.D., a board certified diagnostic radiologist. The plaintiff contended that she received inadequate anesthesia and that during the procedure she reacted to the pain by reflexively hyperextending her neck, thereby sustaining a disc herniation at C3-4. The plaintiff brought this action against the defendant based on medical negligence and malpractice theories of recovery.
