Facts
On Nov. 18, 1990, the decedent, a 61-year-old man, presented to defendant Doctors Medical Center for a repeat triple bypass surgery. The decedent had undergone similar surgery once before in 1982. The November 1990 surgery was performed by defendant James MacMillan, M.D. During the procedure, the defendant doctor severed an old vein graft in order to locate its connection to an artery. The defendant allegedly did not tie off one of the severed ends and the decedent bled to death. The plaintiffs, the decedent's wife and children, brought this action against the defendants based on medical malpractice and negligence theories of recovery.
