Facts

The plaintiff and defendant were in a relationship. The defendant purchased property in her name alone and paid the majority of property expenses. The plaintiff asserted one-half interest in property pursuant to an alleged oral agreement.

Contentions

CONTENTIONS:
The plaintiff contended that even though the real property was in defendant's name alone, the plaintiff paid part of down payment and the ongoing expenses of the real property consisting of trust deed, taxes and insurance.

Settlement Discussions

The plaintiff sought one-half of equity in real property (condominium). The defendant offered $25,000.

Result

Judgment for defendant on C.C.P. 631.8 motion, except as to conversion of three surfboards, boxes of plaintiff's personal items, waterford glasses, cherrywood dresser, leather chair, all of which the defendant will to return to plaintiff.
