Facts

George Weller lost control of his vehicle and crashed through a barricade at the Santa Monica Farmers Market. Weller killed ten people and injured 63 bystanders. The victims and their families sued the city of Santa Monica, Bayside District Corp., Step Up On Second and Weller.

Contentions

PLAINTIFFS' CONTENTIONS:
The plaintiffs contended the city of Santa Monica and Bayside were negligent by failing to provide proper barricades, thus creating a dangerous condition. The plaintiffs also contended Step Up failed to use proper barricades and Weller was negligent in operating his vehicle.

DEFENDANTS' CONTENTIONS:
The city of Santa Monica and Bayside contend they complied with state and city codes. Weller contends the incident was a result of a pedal error.

Damages

Ten killed and 63 people were wounded.

Result

In 2007, Step Up On Second settled for $5 million. In Feb. 2008, the city of Santa Monica, Bayside and Weller settled 40 out of the 42 cases for $15.3 million. In May 2008, the remaining two cases settled for $6,152,000. Weller contributed $500,000, his insurance policy limit. The rest was paid by the city of Santa Monica and Bayside.
