Facts
In October 1997, the plaintiff and defendant, then engaged to be married, purchased a home for $267,000. The
defendant requested that the plaintiff advance $60,000 as down payment on the property and the defendant
promised he would reimburse the plaintiff after the property was purchased. The plaintiff also gave defendant
several thousand dollars in personal loans.
The plaintiff and defendant were to reside on the property as joint tenants with all rights and privileges of joint
tenancy. After the property was purchased, the defendant broke off the engagement and refused to reimburse
the plaintiff the $60,000 advanced or any portion thereof. The defendant also refused to allow the plaintiff
possession and use of the property.
The plaintiff brought this action against the defendant based on partition, fraudulent promise without intention
to perform, breach of contract and common count-monies loaned.
Settlement Discussions
The plaintiff initially demanded $113,953. The defendant offered $45,000.
