In November 1996, the plaintiff, a recovering cocaine user, moved into a private residential sober living home owned by defendants Warren and managed by defendant Gibbs. The plaintiff was a 43-year-old male, 6'1" and 175 pounds. In February 1997, Jerry Smith became a resident of the home. Smith was between 6'2" and 6'4" and approximately 230 pounds. On May 22, 1997, Stanley and Smith got into an argument. Smith assaulted Stanley, resulting in internal injuries and the loss of plaintiff's right kidney.
