The plaintiff provided civil engineering services from October 1996 through June 1998, for the development of the Manhattan Beach Studios pursuant to an oral contract with the defendants. The approximate $40 million project proceeded on an ultra fast track basis, with design, construction and city plan checking all occurring simultaneously. As a result, the project was completed on time so the studioÆs first major tenant, 20th Century Fox, could move in for the fall 1999 television season. Despite the fact that the plaintiff provided all requested services and played an integral role in successfully completing the project, the defendants failed to pay the plaintiff for $155,818 worth of services.
In October 1998, the plaintiff filed a complaint to recover the amount of those unpaid services. The defendants filed a cross-complaint seeking about $1.5 million for alleged project cost overruns.
