Facts

On Oct. 22, 1998, the plaintiff was working as a miner in the metrorail subway tunnel being constructed between Hollywood and Universal City. The plaintiff was seriously injured when a 2,000-pound industrial fan fell on top of his left leg as the fan was being lowered from the top of the tunnel to the ground.
