Facts
On Sept. 4, 1999, the plaintiffs mother and daughter set off to see the scenic splendor of Alaska. They chose the
defendant as their means of travel. While on the cruise ship, they purchased tickets to see the Stikine River by
means of a jet boat. The navigator of the boat left the harbor in the dense fog at a high speed in an attempt to
follow the boat before it.
Just minutes after leaving the harbor, the navigator struck a sand barge and the vessel came to a complete stop.
The plaintiffs were propelled from their seats (which were not equipped with seat belts) and struck their bodies
against the boat.

Injuries
The plaintiff mother, age 83, sustained fracture to her left ankle requiring surgery to mend the bimalleolar fracture. She also had contusions, lacerations and bruising to her wrist, chin and head. Her mobility was hampered as a result of the accident. The plaintiff daugther, age 59, sustained a 3 cm laceration and abrasion to the right side of her face at the zygomatic arch. She also had bruising and abrasions to her left shin. She also suffered from emotional injuries due to her mother's injury.
