On Nov. 1, 1998, the plaintiff, age 42, was participating in a fund raising bicycle ride for police explorer scouts. The plaintiff fell when she rode her bike over some railroad tracks, that the defendant had covered with used carpeting for this event. The railroad tracks were bumpy and this event had riders from 12 years to 81 years old.
