Facts

Al-Haramain Islamic Foundation, a non-profit based in Oregon, sued the U.S. government alleging that the wiretap violated the Foreign Intelligence Surveillance Act (FISA). Plaintiffs alleged that they had been illegally wiretapped by executive branch officials following the 9/11 attacks. The government declared Al-Haramain a terrorist support group, a designation that was upheld by another federal court.

Result

In March, Chief Judge Vaughn Walker granted summary judgment in favor of Al-Haramain after finding that the government illegally surveilled the non-profit. Judge Walker awarded over $2.5 million in attorney fees and $41,000 damages to two plaintiffs who were subjected to the post-9/11 eavesdropping.
