Facts
On August 6, 1990, Defendant police officer shot and killed Plaintiff wife's estranged husband, a 30-year-old self-employed man, in the parking lot of a restaurant in Mission Valley, San Diego. Plaintiff wife and her husband were citizens of the United Kingdom who were in the process of obtaining a divorce. Plaintiff wife had obtained a court order awarding her custody of their 3 children. The day before the shooting Plaintiff's husband had abducted 2 of the 3 children. Plaintiff reported the abduction to Defendant city's police department. Plaintiffs are the estranged wife and 3 children of decedent. No weapons were found in decedent's car nor on his body. The transmission was found to have been shifted from park to neutral.
