On October 10, 1991 Plaintiff was a 1-day-old infant. A phlebotomist at Defendant hospital was assigned to do a "heel stick," pricking the heel to draw blood. A diaper was moistened, placed in a microwave, and wrapped around the baby's foot. When she took it off one minute later, the baby had third degree burns over its foot and ankle and was sent to the UCI burn ward where he spent his first 30 days of life.

Settlement Discussions

Plaintiff contends they demanded $100,000 and Defendant offered $60,000 increased to $70,000. Defendant contends Plaintiff's demand was $150,000.
