Facts

In 2002, Teresa Yeghoian, a 44-year-old legal secretary, was driving her Oldsmobile northbound on SR-43 in Kings County. She was driving between 35 and 40 mph. At the same time, Sarah Morgan was driving her Dodge Dakota eastbound on Flint Avenue. Morgan entered an intersection at SR-43 and Flint without stopping at a posted stop sign. Yeghoian tried to brake, but was unable to stop in time to avoid broadsiding Morgan's vehicle. Yeghoian sued Morgan for vehicular negligence. Morgan admitted liability. The defendant disputed the extent of the plaintiff's injuries and the need for future surgery.

The plaintiff claimed injuries consisting of soft tissue damage to her neck and back, as well as a fracture of the third and fourth metatarsal in her right foot, and a dislocation of the mid-foot. An unsuccessful mid-foot fusion using screws and staples was performed by a podiatrist. An orthopedic surgeon recommended a fusion of the mid-food using a bone graft. Both doctors attributed the plaintiff's injuries to the application of brakes during the accident.
