Mattie Sanders, a 65-year-old retired nurse, was driving a 1973 Chevrolet Malibu south on East Street in Redding on Oct. 21, 2002. As she passed through the Placer Street intersection, her passenger side door was struck by a 1996 Oldsmobile Bravada driven by Eileen Shupp, who was attempting to turn right onto East street.

Sanders sought $26,000 in damages.

Injuries

Sanders asserted that she struck her head, left hip and right knee during the impact. She claimed that the accident significantly aggravated pre-existing arthritic and degenerative conditions in her knee, hip and shoulder, and that it resulted in new injuries to her neck and abdomen. She was transported to an emergency room after the accident, where she received CT scans, ultrasounds and x-rays. She got follow-up care with her primary care physician as well as physical therapy. She claimed that her symptoms would worsen over the course of her life.

Other Information

Defense counsel noted that the award appeared to have been a compromise verdict, because the jury initially voted against the defendant's negligence but, when polled, split 6-6 on the issue.
