Facts

On Oct. 5, 2003, Terrance Mearis, age 20, was asleep when two Oakland police officers, defendants Ryan Gill and Richard Vass, entered his apartment without a search warrant. Mearis was on probation for a drug-related crime. The officers were part of a crime reduction team. A murder and a drive-by shooting has occurred in Mearis' apartment complex. The officers went to Mearis' bedroom and woke him. In a struggle, both officers fatally shot Mearis.

Damages

Mearis' parents claimed he suffered pain and suffering, emotional distress, loss of enjoyment of life and lost future income. The parents claimed funeral expenses, and loss of society and comfort.

Result

The parties settled before trial for $50,000.
