Facts
A class action against the U.S. government was filed on behalf of non-citizens within the Central District of California who were: detained for longer than six months pursuant to one of the general immigration detention statutes pending completion of removal proceedings, including judicial review; are not now or have been detained pursuant to a national security detention statute; and have not been afforded a hearing to determine whether their detention is justified. Plaintiffs sought the right to a bond hearing.
Result
Federal Judge Terry J. Hatter issued a permanent injunction requiring the government to give automatic bond hearings as soon as immigrant detainees have been held for six months to determine if they should continue being detained.
