Biax Corporation claimed that Nvidia and Sony, both, infringed two of its patents (US Patent 5,517,628 and 6,253,313). Biax accuses the Sony defendants of infringing the patents through the sale of products containing RSX graphics processor chips and GeForce NV40 and NV50 processor chips employing a plurality of condition code registers. Biax's claims against Nvidia are based on Nvidia's production of the NV40 and NV50 chips.
On Feb. 15, 2012, the Court granted defendants' motions for summary judgment on all of Biax's claims. Subsequently, defendants filed a motion for recovery of attorney fees and expenses incurred after claim construction.
On March 30, 2013, the Court found that defendants were entitled to recover attorney fees for the time period starting on June 23, 2011, when Biax's expert, Dr. Edward Davidson, conceded the issue of infringement, and ending on March 26, 2012, when the Court issued its order granting summary judgment.
Result
The Court awarded Nvidia $1,283,031 in attorney fees and $28,648 in non-taxable costs. Sony was awarded $688,773 in attorney fees and $10,913 in non-taxable costs.
