In September 1993, plaintiff purchased 13 modular buildings from defendant for resale to the government of Sonora Mexico. Due to alleged substandard quality, plaintiff lost its contract with the government. The plaintiff sued defendant for breach of contract and fraud. The defendant counterclaimed for breach of contract, fraud, conversion, quantum valebant and breach of the implied covenant of good faith.

Settlement Discussions

The plaintiff made a settlement demand for $300,000. The defendant offered $75,000.

Damages

The plaintiff claimed he suffered $388,000 in damages.

Other Information
