Facts

On Jan. 8, 1998, plaintiff, a 36-year-old research scientist, was on bicycle rode northbound into crosswalk on a green light when adverse driver slowing eastbound for right turn failed to stop for plaintiff causing vehicle to strike cycle throwing plaintiff to the ground. The plaintiff alleged negligence, violation of Vehicle Code º21453 (a) (failure to yield right-of-way) and inattention. The plaintiff brought this action against the defendant based on negligence.

Settlement Discussions

The plaintiff made a settlement demand for policy limits. The defendant made an offer of $350,000 (policy limits).

Injuries

The plaintiff sustained intra-articular open fracture of left ankle following auto versus bicycle collision on Jan. 8, 1998. The plaintiff also claimed significant residuals including removal of hardware, post traumatic arthritis and possible future ankle fusion.

Other Information

The settlement was reached approximately one month after the case was filed.
