On Sept. 26, 1996, plaintiff Madelena Jacobson, an executive secretary, with pre-existing limp due to multiple sclerosis, was standing at the garage elevator of the building owned by defendant William Kimball. Defendant Ronald Hansen arrived with his sharpei dog. As the plaintiff entered the elevator, the defendant's dog brushed passed the plaintiff, startling her and she fell. The plaintiff brought this action against the defendants based on negligence.
