Facts
The patient, a 60-year-old diabetic male, presented to the defendant cardiologist Dr. Harout Mesrobian with complaints of "new onset" chest pain. An office stress test reproduced the pain but no EKG changes were evident. The patient was scheduled for a thallium stress test in the hospital and continued to experience resting chest pain between the time he left the doctor's office and the time of the stress test. During the recovery phase of the stress test, the patient demonstrated striking ST segment depressions evidencing severe ischemia and predictive for a major coronary event. The patient was sent to his room for lunch. Sixteen minutes after lunch, the patient experienced a lethal arrhythmia and died following a Code Blue effort to resuscitate him. The plaintiffs, the decedent's wife and daughter brought this action against the defendant based on medical negligence.
Settlement Discussions
The plaintiffs made a settlement demand for $225,000. The defendant made no offer.

$257,000 in damages and $7,000 in funeral expenses.
