Facts
On July 7, 1991, Plaintiff, a 46-year-old elementary school teacher, was a passenger in her husband's car as they drove down Ventura Boulevard in Encino. Defendant, who was driving parallel to them, made an unsafe lane change and collided with plaintiffs' automobile. Defendant was attempting to enter a driveway. Plaintiff driver was a 49-year-old dentist at the time.

Plaintiff passenger: Soft tissue neck and back with exacerbation of pre-existing scoliosis requiring physical therapy; disc rupture at C5-6 requiring fusion and anterior microdiscectomy with osteophytectomy; L4-5 herniation requiring possible future surgery. Plaintiff driver: growth on the tendon of the left hand causing pain in the palm and fingers and curling of the hand requiring future surgery.
