Contentions

PLAINTIFF'S CONTENTIONS:
Boss claimed that on June 19, 2012, she was driving when two other vehicles hit her. The two vehicles pushed her off the road, causing her to hit a tree. Boss sued Khalil and Do, the other drivers, arguing that they had caused the accident. She claimed that Khalil made an unsafe lane change, hitting Do and then causing both vehicles to be run off the road.

DEFENDANT'S CONTENTIONS:
Khalil contested Boss' damages, arguing that she was not entitled to the amount she was seeking.

Settlement Discussions

Boss demanded $5.25 million to settle. Khalil offered $1.3 million, pursuant to CCP Section 998.

Damages

Boss requested $225,000 for past medical costs and $500,000 for future medical costs.

Injuries

Boss fractured her knees and right femur. She required surgery, and later underwent physical therapy. She also claimed to suffer from post-traumatic stress disorder after the accident.

Result

Do settled with Boss early in the proceedings for $15,000. The jury awarded Boss $2,425,000 against Khalil.
