The parties entered into a written contract in May 1997, whereby the defendant would supply the plaintiff with
super chargers for diesel trucks, intended for export to Russia. He imported a Russian truck for testing.
The plaintiff contended that the defendant breached the agreement by failing to supply the super chargers and
refusing to accept the imported truck for the required testing. The plaintiff claimed lost profits of $19 million.
The defendant contended that the plaintiffs did not supply the truck, and when they finally did, it was
inoperable and not capable of being used.
