On March 21, 1996, the plaintiff, age 11, while playing with friends near her home, was bitten by the defendantÆs
dog.
The plaintiff contended that the defendant was strictly liable under C.C. Section 3342. In addition, the dog had
been to its veterinarian earlier in the day, was not well and should not have been out in public.
The defendant contended that the plaintiff and her friends provoked the dog.
