Cross-complainant James David was arrested for battery based on the police report by Lana Le and Janet Rehak,
claiming that he had pushed Le in the condominium common area. Cross-complainant James David claimed
that he did not batter Le and that he was falsely arrested. Cross-complainants claimed that cross-defendant
Mar-Mac Terrace had targeted them with unreasonable enforcement of the condominium association rules.
The defendants alleged that James David did commit battery on Le and that Mar-Mac Terrace Homeowners
Association did not enforce its rules unreasonably.
Cross-complainants sued for false imprisonment, intentional infliction of emotional distress and breach of
fiduciary duty.

Other Information

The case was settled while post-trial motions for attorney fees and costs were pending.
