Facts

On April 15, 1998, the defendant presented to the plaintiff an opportunity to loan money to the defendant, at 4
percent interest per month. The parties executed a promissory note providing that the plaintiff would loan the
defendant $200,000. The entire principal was due on Aug. 15, 1998. The defendant made an interest payment
in August 1998, and failed to pay the principal and interest thereafter.
