Facts

The minor plaintiff, a 3-year-old boy, fell out of the basket portion of a grocery shopping cart while shopping with
his parents at a Food-4-Less grocery store in Yuba City. The plaintiffÆs 2-year-old brother was seated in the
seat portion of the shopping cart at the time of the accident.
The boysÆ father was attending to the two-year-old who was attempting to climb out of the seat when the
accident occurred. The shopping cart was designed and manufactured by defendant Rherig International.

Settlement Discussions

The defendant indicated that it would offer up to $25,000. The plaintiff demanded $4 million.

Injuries

The plaintiff sustained a subdural hematoma requiring surgical repair, as well as permanent brain damage.
