Facts
On March 1, 1999, plaintiff Karla Olson, age 55, fell off of a ladder, thereby resulting in a Class 3 pilon fracture
to her tibia and a nondisplaced transverse fracture of her fibula. She was taken to the emergency room at
Glendale Adventist Medical Center where she was admitted and seen by defendant Dr. Horace Jenkins.
On March 2, Dr. Jenkins performed an open reduction and internal fixation of the tibia fracture and placed her
in a posterior molded splint. X-rays on March 4, reveal that the fractures had been adequately reduced and
stabilized.
Thereafter, on March 5, the plaintiff terminated Dr. JenkinÆs services because he had not seen her
posoperatively. The plaintiff then retained Dr. Philip Merritt to manage the remainder of her hospital course.
On March 8, X-ray films demonstrated that the repair Dr. Jenkins had performed had fallen apart and that the
fibula fracture was displaced.
Settlement Discussions
The plaintiffÆs demand prior to trial was $65,000; defendant indicated possible payment of $25,000. No formal offer was made to the plaintiff.
