On Nov. 5, 1998, at approximately 9 p.m., the plaintiff was driving southbound on 101 just north of Ventura city
limits when she struck a dead cow in her lane. The cow was owned by the defendant, and had escaped from the
defendantÆs property adjacent to freeway through hole in a fence. The cow had gotten out about 36 hours
previously along with five others. California Highway Patrol had called the defendant who rounded up all but
this cow which remained out undetected.
