On Feb. 1, 1999, the plaintiff, age 79, was walking through the common area of his residence, when he slipped
and fell as a result of the slippery nature of the walkway due to water from adjacent sprinklers and planters
flooding the walkway.

Settlement Discussions

The plaintiff made a C.C.P. Section 998 demand for $150,000 shortly prior to trial. The defendants initially made no settlement offers, then made an offer of $60,000 shortly before the trial date.
