Facts
According to the plaintiff: The case involved the death of Daniel Barnes, an 18-year-old computer animation
student at the Art Academy College. Daniel was killed while riding as a passenger in an Acura owned by Betty
Capp and operated by Danielle Capp. Danielle accelerated through a stop sign at the intersection of Mariposa
Road and Van Allen Road in Stockton. Upon entering the intersection, the vehicle was immediately struck by a
tomato truck owned by defendant Valley Farms Transport.
Because liability for the incident was the responsibility of Danielle Capp, at trial, plaintiffs
George and Lisa Barnes, the parents of Daniel Barnes, offered to dismiss Valley Farms from the
action. The jury found Capp 100 percent liable.
