Facts

On May 6, 1996, the defendant was running an errand for his employer in his pick-up truck. The plaintiff
contended that the defendant rear-ended her vehicle, who was yielding the right-of-way pursuant to the yield
sign on Avondale Road.
The defendant contested liability, that he saw no traffic with which the plaintiff should have stopped for, in
spite of the fact that he admitted he was looking down Avondale at the next intersectionÆs green light. The
defendant contested causation, arguing that the impact was only minimal and not capable of producing any
injury.

Settlement Discussions

The plaintiff made a settlement demand open, and the defendant made an offer for $500,000 plus mediation fees.
