Facts
On Sept. 21, 1995, the plaintiff, a 29-year-old video store clerk, was operating his bicycle in the curb lane of De Soto Avenue. The defendant driver who was in the course and scope of his employment for the defendant trucking company, was operating an 18-wheel tractor-trailer rig alongside the plaintiff. The defendant driver made a wide right turn and the plaintiff struck the rear side of the trailer, fell and went under crushed by the rear wheels of the trailer. The plaintiff brought this action against the truck driver and his employer based on a negligence theory of recovery.
