Facts
Plaintiffs Michael Grossman M.D. and Paul and Jennie Wexler hired defendant Regal Rents to erect a tent for protection against the elements for a Valentine's Day wedding. On Feb. 14, 1993, the day of the event, it started to rain, then hail, and then sleet. The weight of the water caused the tent to collapse on the wedding reception. The plaintiffs brought this action against Regal Rents for emotional distress (due to loss of the wedding reception) based on a negligence theory of recovery.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $29,999.99. The defendant made a C.C.P. º998 offer of compromise for $5,000.
Damages
The plaintiffs claimed $52,000 in damages.
Other Information
The verdict was reached approximately three years and three months after the case was filed. A settlement conference was held on Oct. 24, 1996 before Judge Stephen Peterson. It did not resolve the matter.
