Facts

The plaintiff company entered into an agreement with the defendant whereby the plaintiff would transport the defendant's goods to their intended destination, in exchange for payment. The plaintiff allegedly arranged for transported the goods, but the goods never made it to their destination. On Feb. 3, 1995, the defendant who had agreed to pay, filed bankruptcy. The plaintiff brought this action against the defendants based on breach of contract theories of recovery.
