Facts

On Nov. 26, 1994, the plaintiff stopped at a red light when the defendant drunk driver rearended him. The plaintiff and the defendant were both transported to the hospital and the defendant was later charged with driving under the influence. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
