Facts
Sonia Hofmann brought a class action lawsuit against True Religion Apparel Inc. for allegedly mislabeling certain products as "Made in USA."
Contentions
PLAINTIFF'S CONTENTIONS:
Hofmann contended that True Religion, a manufacturer, distributor, and retailer of jeans, labeled jeans as "Made in USA" even though they were made with foreign-made buttons, rivets, zipper assembly, thread, and/or fabric. Plaintiff claimed that True Religion falsely marketed to consumers that its jeans were "Made in USA" in violation of California law.
Plaintiff asserted claims for violation of California Business and Professions Code sections 17200, et seq., violation of California Business and Professions Code section 17533.7, violation of the Consumers Legal Remedies Act, and negligent misrepresentation.
DEFENDANT'S CONTENTIONS:
True Religion denied any wrongdoing.
Result
Under the terms of the settlement reached between the parties, True Religion will give eligible class members one True Religion T-shirt valued at approximately $25 per shirt. It also agreed to revise its labels to comply with Business and Professions Code Section 17533.7 in relation to all future sales of its products.
