Lyle Galeener, Matthew Vargas, Erik Brown, Jesse Howell, Keith Brown, and Joseph Metko filed a wage and hour class action against Source Refrigeration & HVAC Inc.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs worked as hourly-paid employees for defendant. Plaintiffs claimed they each worked more than 40 hours in a workweek. Plaintiffs claimed defendant had a policy of paying service technicians different hourly rates based on shifts worked. Consequently, plaintiffs were not paid overtime pay. As such, plaintiffs sued defendant, seeking unpaid wages and other damages under the Fair Labor Standards Act, the Arizona Revised Statute, the California Labor Code, and the Business and Professions Code. Plaintiff also sought unpaid wages and other damages under other applicable Wage Orders including, the Colorado Revised Statute, Florida Minimum Wage Law, the Georgia Minimum Wage Law, the Idaho Code, the Nevada Revised Statutes, the New Mexico Minimum Wage Act, the Oregon Revised Statutes, the principles of quantum meruit pursuant to the state laws of Texas, Alabama, Minnesota, Montana, Nebraska, Oklahoma, North Carolina, South Carolina, Tennessee, Utah, and Wyoming, and the Washington Minimum Wage Act.

DEFENDANT'S CONTENTIONS:
Defendant adamantly denied all liability.

Result

The parties reached a $10 million settlement.
