According To the Plaintiff: On Jan. 12, 2002, at approximately 7:25 a.m., the plaintiff, Karmen Grigorian, 36, was operating her 2001 Toyota Highlander westbound on the SR-2 Glendale freeway, approaching the transition to the southbound I-5 Golden State freeway. The defendant Samuel Helman, was operating his 1989 Nissan Sentra ahead of the plaintiff's vehicle in the lane immediately to her right. As both vehicles were approaching the two lane transition to the southbound I-5 freeway, the left rear wheel and tire of Heilman's 1999 Nissan Sentra separated entirely from his vehicle and entered into the plaintiff's lane of travel directly in the path of her vehicle. The incident occurred so suddenly and unexpectedly that the plaintiff had no reasonable opportunity either to slow significantly the speed of her vehicle or to divert her path of travel. The front of the plaintiff's 2001 Toyota Highlander struck the free-rolling wheel and tire causing the plaintiff's vehicle to become airborne and to collide violently into a cement wall, which forms a portion of the transition tunnel between the westbound SR-2 and southbound I-5 freeways. The defendant denied liability and contended that the plaintiff did not sustain head injury.

Injuries

The plaintiff sustained injuries which included closed head injuries with cognitive impairment, small left rotator cuff tear and 2-3 mm disc protrusion in the neck.
