Facts

The plaintiff, a Vietnam veteran, a multiple felon and heroin addict was released from prison in 2000. He went to work as a flagman in 2001. He was taking prescription methadone. On June 27, 2002, the plaintiff was employed as a flagman and was controlling traffic at a project. The defendant driver was driving a truck and dump trailer. While he was turning left, the end of the dump trailer struck the plaintiff and then ran over the plaintiff's right foot, his leg and abdomen.

Settlement Discussions

The case settled for $1 million after three mediations held before R.A. Carrington.

Injuries

The plaintiff suffered a severe degloving injury from above his right knee to his pelvic area; a crushed foot; a crushed left hand and a fracture to his left little finger. The plaintiff-in-intervention paid approximately $250,000 in medical expenses and disability payments.
