Facts

According To The Defendant: The plaintiff, Michael Seaman, a 37-year-old plumber, claimed that he fell down some basement stairs on the defendant's property while giving an estimate regarding a leaking water heater. The plaintiff was in the course and scope of his employment as a plumber for Mike Sterns Plumbing at the time of the accident. Preferred Employers Insurance was the workers' compensation carrier for Mike Sterns Plumbing and brought a separate action. The plaintiff sued the defendant directly and also brought a workers' compensation claim against his employer. The defendant contended that the plaintiff was comparatively negligent and that the defendant had no notice of the defective condition of the stairs.

Settlement Discussions

The plaintiff made a demand of $300,000, the policy limits. The defendant did not make an offer.

Damages

Plaintiff Michael Seaman claimed $22,000 in medical bills that were not paid by the workers' compensation carrier, as well as lost past and future income. Plaintiff-in-intervention Preferred Employers Insurance claimed $97,000 for benefits paid to Michael Seaman.

Injuries

The plaintiff claimed to suffer soft tissue injuries to his neck, both shoulders, and mid and lower back. He further claimed he was unable to continue work as a plumber.
