Facts
In November 2001, defendant Josephine Hermida, who was driving a 1987 Cadillac Seville, exited a parking lot and made a right turn onto Sycamore Street in Hayward. While exiting, she made a wide turn around a stopped delivery truck and slightly crossed the double yellow lines. The right front corner of her Cadillac sideswiped the rear driver's side of an Acura driven by plaintiff Deanna Steward. The plaintiff sued the defendant alleging vehicular negligence.
Settlement Discussions
The plaintiff made a demand of $9,999. The defendant made an offer of $1,000.
Damages
The defendant contended that the impact between the vehicles was minimal and the property damage to both cars was slight.
Injuries
The plaintiff claimed to have suffered soft-tissue injuries to her neck, lower back and shoulder. Four months after the accident, she began treatment with a chiropractor. The plaintiff claimed that she continued to have residual pain. The defense disputed the nature and extent of the plaintiff's alleged injuries and damages.
