Michael Masso, 74, the sole proprietor of a kindergarten through 12th grade private school, was driving eastbound on Whittier Boulevard in La Habra in a Plymouth Reliant. The streets were wet from earlier rains. Masso entered the intersection of Whittier and Walnut Avenue intending to make a left turn. When the light for his direction of travel turned yellow, he saw a Chevrolet Blazer, driven by Kenneth Schrader, traveling westbound on Whittier. Believing it was safe to proceed, Masso made the turn. Schrader's vehicle collided with Masso's vehicle. Masso sued Schrader, alleging vehicular negligence.
Settlement Discussions
Masso demanded $100,000 after arbitration award of $16,000. Schrader offered nothing.
Injuries
Masso claimed injuries consisting of a right clavicle fracture, neck pain and abrasions to his body. He also claimed that his pre-existing tremors in his right hand worsened as a result of the accident.
