Facts

Luis Moreno filed suit against the City of Concord, alleging that police officers used excessive force during a traffic stop. Moreno alleged that he was traveling home when he stopped to buy some beer. An officer then stopped Moreno and arrested him for being unlicensed. A confrontation ensued, and when Moreno tried to run toward his home, the officer fired Taser darts at him. Three darts hit him in the back and neck, causing Moreno to fall face first onto blacktop.
