Facts

A taxpayers group filed suit against Santa Clara County, seeking to overturn a $543 million parcel tax approved by voters in November. The taxpayers argued that the Santa Clara Valley Water District failed to provide 24 hours notice for a meeting to place the item on the ballot. Instead, the District only provided 23 hours prior notice in posting the agenda of its August 8 board meeting.

Result

The Court found that the mistake was merely a technical deficiency and refused to overturn the tax.
