Facts
On June 13, 1998, the plaintiff, age 47, had her blood drawn by defendant's employee, a phlebotomist. The plaintiff alleged that during the blood draw, it felt like "a thousand bees were stinging her," and she advised the phlebotomist of this. The plaintiff claimed the phlebotomist did not stop the procedure, but withdrew four vials of blood. The plaintiff presented to the defendant clinic two days later, complaining of burning pain since the time of the blood draw. The plaintiff has been unemployed since the date of injury, and on disability, due to nerve injury and resultant depression.
