Facts

This is an incident that occurred on the 57 freeway southbound. Plaintiff/defendant Sherrard was driving a 1995 Nissan Maxima. Defendant Brondani was driving a 1986 BMW 735. Plaintiff Atluri was driving a 1987 Toyota Corolla. Plaintiff Kim was a passenger in Brondani's vehicle. Plaintiff Atluri contended that he was sitting in his car and was rear-ended. Plaintiff Kim contended Sherrard crossed from the number one lane to the HOV lane abruptly cutting off her vehicle and causing the accident and her injuries. Plaintiff/defendant Sherrard was suing for fractured ribs and facial scars. Plaintiff/defendant Sherrard contended that defendant Brondani exited the carpool lane suddenly and contacted his left rear. Defendant Brodani and plaintiff Kim contended that plaintiff/defendant Sherrard left the number one lane and cut in front of their car causing them to contact his car. Plaintiff Atluri was ahead of traffic in his car and was rear-ended by an unknown wehicle.

Settlement Discussions

Hae Kim demanded $135,000; Sherrad demanded $12,000; Atluri dismissed his case.

Injuries

Plaintiff Atluri was not hurt by the accident. Plaintiff/defendant Sherrard suffered fractured ribs, facial cuts and soft tissue injuries. Plaintiff Kim suffered a fractured left humerus.

Other Information

This case was stipulated as to damages. Defendant Brondani stipulated they would pay plaintiff Sherrard $12,000 in the event liability was found. Defendant Sherrard agreed to pay plaintiff Hae Kim $70,000 for her broken left humerus in the event liability was found against him.
