Facts

Decedent, wife and mother to five adult children, was diagnosed with hepatitis C approximately five years prior to her death at the age of 54. It was believed that the hepatitis was contracted through blood products. The decedent was ultimately referred to defendant hospital facility where she was diagnosed with end-stage liver disease and placed on the liver transplant list. On Nov. 7, 1996, the decedent was advised that a liver had been found and she underwent a successful liver transplant the next day. Several hours after the surgery, the defendants, hospital and its employees, placed a jugular venous catheter in the decedent. Shortly thereafter, the decedent died.

The plaintiffs served a demand for settlement pursuant to C.C.P. º998 in the amount of $225,000.
